An Ohio marriage may be annulled for any of the following grounds that existed at the time of the marriage:

  • The party seeking to have the marriage annulled was under the age at which persons may be joined in marriage, unless after attaining that age the parties lived together as husband and wife;
  • The former husband or wife of either party was living and the prior marriage was in force during the subsequent marriage;
  • Either party is found to be mentally incompetent, unless the couple lived together as husband or wife after competency was restored;
  • The consent of either party was obtained by fraud, unless the party learned of the fraud and still lived as husband or wife;
  • The consent to the marriage of either party was obtained by force.
