Annulment

While a divorce and dissolution of marriage terminate a valid marriage, an annulment declares that a legal marriage did not exist in the first place.

If you are contemplating an annulment, please contact the Law Offices of David A. Looney Co. LPA at 330-785-3337, or fill out our contact form . Serving clients in the Summit, Portage and Medina counties of Ohio, we have 30 years of legal experience. We are aggressive, equipped and prepared to fight for you and help you solve your legal problems.

It's a common misconception that only short-term marriages can be annulled, but the length of a marriage is not an issue for an annulment.

An Ohio marriage may be annulled for any of the following grounds that existed at the time of the marriage:

  • The party seeking to have the marriage annulled was under the age at which persons may be joined in marriage, unless after attaining that age the parties lived together as husband and wife;
  • The former husband or wife of either party was living and the prior marriage was in force during the subsequent marriage;
  • Either party is found to be mentally incompetent, unless the couple lived together as husband or wife after competency was restored;
  • The consent of either party was obtained by fraud, unless the party learned of the fraud and still lived as husband or wife;
  • The consent to the marriage of either party was obtained by force.

The experienced family law attorneys at the Law Offices of David A. Looney Co. LPA can advise you as to whether those circumstances apply to your situation. Call us at 330-785-3337, or fill out our contact form .
